Scope and Content Note

This collection consists of microfilm copies of York District Court of Equity and York County Court of Common Pleas journals dating from 1841 to 1870. The records document proceedings and actions heard before the Court of Equity and, following the judicial reorganization established by the South Carolina Constitution of 1868, the York County Court of Common Pleas.

The collection contains Journal B (1841–1848), Journal C (1848–1859), and Journal D (1860–1870). These journals record summaries of court proceedings, rulings, motions, decrees, and related judicial actions involving equity cases and civil matters. The records provide valuable documentation concerning legal disputes, property settlements, estates, guardianships, debt cases, and other matters handled by the courts during the mid-nineteenth century.

The microfilm reproduces the original volumes titled York District Court of Equity Journal B, 1841–1848; York District Court of Equity Journal C, 1848–1859; and York District Court of Equity, York County Court of Common Pleas, Journal D, 1860–1870[1], held by the South Carolina Department of Archives and History.

[1] The District/County on the title page of this roll of microfilm is used for a record with entries dated before and after the change in designation of judicial districts to counties as specified by the South Carolina Constitution of 1868.

The Equity/Common Pleas or Equity/Probate on the title page of this roll of microfilm is used for a record that began in the Court of Equity and continued into the Common Pleas or the Probate Court after the Court of Equity was abolished, effective January 1, 1869, by the South Carolina of 1868.
