Scope and Content Note
This collection consists of microfilm copies of the York District and York County Returns in Partition Book records dating from 1845 to 1873. The records document partition proceedings handled first by the York District Court of Equity and later by the York County Court of Common Pleas following the judicial reorganization mandated by the South Carolina Constitution of 1868.
The collection includes returns in partition involving the division and distribution of real property among heirs, co-owners, and estates. Records typically contain descriptions of land, names of heirs and interested parties, valuations, plats or references to surveys, reports of commissioners, and court determinations regarding the partition or sale of property. The records provide valuable information concerning land ownership, inheritance practices, family relationships, and local legal proceedings in York District and York County during the mid-nineteenth century.
